Terms of Service — TradeQuote

Please read these Terms of Service carefully before using TradeQuote. By creating an account or using the service, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing or using TradeQuote at our website, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.
TradeQuote is operated by Emir Husain, an individual operating under Indian law.

2. Description of Service

TradeQuote is a web-based software-as-a-service (SaaS) application that allows tradespeople and contractors to create professional quotes, convert them to invoices, send them to clients, and track payment status.

3. Account Registration

  • 3.1 You must register for an account to use TradeQuote. You agree to provide accurate, current, and complete information.
  • 3.2 You are responsible for maintaining the confidentiality of your password and for all activities under your account.
  • 3.3 You must notify us immediately at tradequote.support@gmail.com if you suspect unauthorised access to your account.
  • 3.4 You must be at least 18 years old to use TradeQuote.

4. Acceptable Use

You agree NOT to use TradeQuote to:

  • Violate any applicable Indian or international laws
  • Create fraudulent quotes or invoices
  • Impersonate any person or entity
  • Attempt to gain unauthorised access to our systems
  • Transmit malware, viruses, or harmful code
  • Scrape, crawl, or extract data from the platform in bulk
  • Resell, sublicense, or commercially redistribute the service without written permission

5. Free Plan and Paid Subscriptions

  • 5.1 Free Plan: The Free Plan allows up to 5 combined sent quotes and invoices per month. We reserve the right to modify free plan limits with 30 days' notice.
  • 5.2 Paid Plans: Pro Plan: $35/month. Business Plan: $65/month. Prices are in US Dollars (USD).
  • 5.3 Billing: Subscriptions are billed monthly on the same day each month. Payment is processed by our payment provider. Your subscription renews automatically until cancelled.
  • 5.4 Cancellation: You may cancel your subscription at any time from Settings → Billing. Upon cancellation, you retain access until the end of the current billing period. No partial refunds are given for unused days (see Refund Policy).
  • 5.5 Price Changes: We may change subscription prices with 30 days' advance notice via email. Continued use after the notice period constitutes acceptance of new pricing.

6. Data Ownership

  • 6.1 You retain full ownership of all data you enter into TradeQuote — your client information, quotes, invoices, and business details.
  • 6.2 We do not claim any intellectual property rights over your content.
  • 6.3 You grant us a limited licence to store and process your data solely for the purpose of providing the service.

7. Service Availability

  • 7.1 We aim for high availability but do not guarantee 100% uptime. Scheduled maintenance will be announced in advance where possible.
  • 7.2 We are not liable for any losses resulting from service downtime, data loss, or technical failures, to the maximum extent permitted by law.

8. Intellectual Property

The TradeQuote name, logo, website, and application code are owned by Emir Husain. You may not copy, modify, distribute, or reverse-engineer any part of the service.

9. Limitation of Liability

To the maximum extent permitted by applicable Indian law, TradeQuote and Emir Husain shall not be liable for:

  • Any indirect, incidental, or consequential damages
  • Loss of profits, revenue, or business opportunities
  • Loss of data
  • Any claim arising from your use or inability to use the service

Our total liability to you for any claim shall not exceed the total amount you paid us in the 3 months prior to the claim.

10. Indemnification

You agree to indemnify and hold harmless Emir Husain from any claims, losses, or expenses (including legal fees) arising from your violation of these Terms or your use of the service.

11. Termination

  • 11.1 We reserve the right to suspend or terminate your account, with or without notice, if you violate these Terms.
  • 11.2 You may delete your account at any time from Settings or by emailing tradequote.support@gmail.com.
  • 11.3 Upon termination, your right to use the service ends immediately. We will retain your data for 30 days after termination, then permanently delete it.

12. Governing Law and Disputes

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Firozabad, India.
Before initiating legal proceedings, you agree to first attempt to resolve disputes by contacting us at tradequote.support@gmail.com. We will respond within 15 business days.

13. Changes to Terms

We may update these Terms at any time. We will notify you by email at least 14 days before significant changes take effect. Continued use of the service after changes constitutes acceptance.
